- Purpose The purpose of these bylaws is assist in the definition of roles and duties of the Pack, Dens, Leaders, Scouts, and Parents. The Pack 36 Bylaws is a support document to the CUB SCOUT Leader Book and cannot supersede or override the CUB SCOUT Leader Book or any BSA policy. Any perceived conflict between these Bylaws and the CUB SCOUT Leader Book or BSA policy should be brought to the attention of the Pack 36 Committee Chairperson or Cubmaster as soon as possible.
- Membership
- Boys wanting to join Pack 36 may be assigned to a Den or Patrol of their choice, if the Den/Patrol Leader agrees and the Den/Patrol size and leadership ratio rules are not violated.
- The Cubmaster will assign boys wanting to join Pack 36 with no preference to Den/Patrol assignment to a Den/Patrol.
- Scouts and parents will be discouraged from moving from one den/patrol to another. Changing Dens/Patrols may be done only after the parents, present Den/Patrol Leader, Cubmaster, and Committee Chairperson have met and discussed the reason. The transfer may occur if the gaining Den/Patrol Leader agrees to accept the transfer and the Den/Patrol size and leadership ratio rules are not violated.
- Den and Patrol Size
- Pack 36 Den or Patrol size shall be limited to an active role of ten scouts and a total role of fifteen scouts.
- Dens and Patrols may temporarily (less than six months) operate with up to twelve active Scouts. During this period, the Den/Patrol Leader, Asst. Den/Patrol Leader, Cubmaster and Committee Chairperson will meet to determine a method for bringing the Den or Patrol to a manageable size. If after five months, no resolution to the problem can be discerned, the Cubmaster and Committee Chairperson shall call a meeting of all the parents and Den/Patrol Leaders of Scouts of that age group. The Cubmaster and Committee Chairperson will explain the problem and re-assign the Scouts to smaller Dens/Patrols or ask for volunteers to start a new Den/Patrol.
- Dens and Patrols in Pack 36 shall maintain a ratio of not more than ten Scouts for every two trained adult Scout Leaders.
- Attendance
- Den/Patrol and Pack Events and Meeting Scouts will maintain their attendance at Pack and Den/Patrol meeting and functions on a regular basis. Excessive absence will be construed as a lack of interest in Scouting. The scout will be contacted by their Den/Patrol Leader to ascertain his status. In case he continues to be inactive, by admission or by deed, his name will be placed on an inactive list and dropped from the roles at the next Pack re-chartering. Scouts are expected to advise their Den/Patrol Leader of any anticipated or extended absences.
- Pack Committee Meetings Den/Patrol representation at the Pack Committee Meetings is mandatory. Pack planning cannot be done democratically if all Dens/Patrols are not actively participating by voicing their opinions and casting their votes. Knowledge of the Pack plans and functions cannot be relayed to the scouts if the Den/Patrol representative is not present. Pack Committee meetings are held on the third Monday after the second Wednesday Round Table Meeting of each month, except June and July.
- District Event and Meetings
- Pack attendance at District sponsored activities is recommended.
- Adult Pack representation at District Roundtable meeting is desired.
- The Pack shall avail itself to District and Cub Scout Training as required to keep all personnel adequately trained in Scouting. The Committee has the option to provide funds for adult training.
- Discipline
- Definition of Misbehavior
- Serious misbehavior or breach of conduct is defined as, but not limited to, the following: Compromising the safety of oneself or others, Theft, Lying, Profanity, Fighting, Vandalism, willful refusal to follow a Scout Leaders' directions and/or repeated (defined as three or more instances) general misbehavior that affects the ability of the Den/Patrol to function.
- General misbehavior is defined as, but not limited to, bad sportsmanship and disrespect to others.
- All adults attending Scouting functions will be subject to the same rules as the Scouts and Scout Leaders.
- Disciplinary Process
- Any Scout who misbehaves in a serious or general manner will be taken aside by two adult Scout Leaders and warned of their misbehavior. Should the Scout continue to misbehave the parents will be notified by telephone as soon as possible, requesting they pick up their Scout. If the parent is unable to pick up the Scout, two trained adult Scout Leaders may accompany the Scout home and discuss the matter with his parents.
- The adult Scout Leader and parent shall resolve general misbehavior. Should this behavior persist so as to become serious in nature as defined under Definition of Misbehavior of these By Laws or the Scout Leader and parent cannot resolve the general misbehavior an investigation may be convened at the request of either party. This investigation will proceed as detailed for serious misbehavior.
- Should the Scout Leader and parents fail to correct any serious misbehavior of a Scout, an investigation shall be conducted by at least two trained adult Scout Leaders.
- The investigating Scout Leaders shall not be related to the Scouts involved. Parents of the Scouts involved shall be notified immediately upon the decision to commence an investigation into their Scouts conduct.
- The parents of the Scout may be present for all parts of the investigation and determination of punishment.
- At the conclusion of the investigation, the investigating Scout Leaders shall submit a report to the Cubmaster.
- The Cubmaster shall determine if punishment is warranted and what the punishment shall be.
- In the event that the punishment is dismissal from the Pack, the Pack Committee and Charter Representative shall be notified as soon as possible.
- The Scout may appeal the determination of punishment at the next Pack Committee meeting.
- The Pack Committee Chairperson shall appoint a Disciplinary Appeals Committee to hear the appeal.
- The Appeals Committee shall be composed of three Scout Leaders or parents who did not investigate or determine punishment for the misbehavior and who are unrelated to the scouts involved.
- The decision of the Appeals Committee is final.
- Administration of Punishment
- Serious Misbehavior
- Punishment for serious misbehavior shall be determined by the Cubmaster and may range from being barred from participating in Den/Patrol or Pack events for one month to dismissal from the Pack. Written notification detailing the incident, punishment, and a copy of the Pack 36 Bylaws shall be forwarded to the Scout's parents.
- Any Scout who misbehaves in a serious manner for a second time as determined by this Disciplinary Process shall be dismissed from the Pack. Written notification detailing the incident and a copy of the Pack 36 Bylaws will be forwarded to the Scout's parents.
- General Misbehavior
- Any Scout who misbehaves in a general manner will be taken aside by two trained adult Scout Leaders, given a verbal warning and explanation of the Pack Bylaws.
- The Scout Leader and parent will determine the punishment for a second offense of general misbehavior that may range from being removed from the Den/Patrol meeting to being barred from participating in Den/Patrol or Pack activities for a period of one month. Should an investigation be convened, as defined in the Disciplinary Process of these By Laws, at the request of either the Scout Leader or parent the Cubmaster shall determine the punishment. In either instance, written notification detailing the incident and punishment and a copy of the Pack 36 Bylaws shall be forwarded to the Scout's parents. .
- Pack Yearly Schedule of Events A draft of the Pack schedule for the next year (September through September) shall be distributed for review in June. Comments to the schedule will be adjudicated. The finalized schedule shall be approved and distributed at the August Committee meeting.
- Pack Finance
- Pack Budget A draft of the Pack budget for the next year (August through August) shall be distributed for review at the August Committee meeting. Comments to the budget shall be adjudicated. The finalized budget shall be approved and distributed at the August Committee meeting.
- Pack Fund-raisers Participation in the Pack fund raising activities is voluntary, but recommended.
- Pack Dues If Pack fund raising activities are projected to be insufficient to offset Pack budgeted expenditures, Pack dues may be established. The Pack dues rate will be approved with the Pack annual budget at the August Committee meeting. The Pack dues may be collected quarterly, semi-annually, or annually to meet the Packs cash flow.
- Bank Account There shall be at least two names on the Pack's bank account. All checks written on the Pack's account shall bear one of the following person's signatures: Pack Treasurer, Committee Chairperson, or Cubmaster. Detail of the expenditure from this fund shall be included in the annual financial statement.
- Scout Store Accounts An account will be maintained at the Council Office for supplies and advancements. Detail of the expenditure from this fund shall be included in the annual financial statement.
- Annual Financial Statement An audit report shall be given annually by the Treasurer at the August Committee Meeting. This report shall include details of all Pack accounts and budget variance analysis.
- Organizational Structure and Pack Executive Positions
- The Pack Committee shall approve the Pack Organization Structure and persons filling Pack executive positions in structure at the May Committee meeting.
- Persons filling the Pack executive positions will be introduced to the Scouts and parents at the September Pack meeting.
- Distribution of Pack Information Copies of the Pack Bylaws, Yearly Schedule of Events, Yearly Budget, and Organizational Structure shall be made available for all parents and Scouts in the Pack in order that they will be aware of the desire the Committee has to assure safe and orderly operation of Pack 36 for all Scouts. Distribution of these documents shall be made annually, in September, and on an as needed basis throughout the year.
- Review of Bylaws The Pack Committee shall conduct a review of the Pack Bylaws annually. Changes may be made at any time during the year. Changes will be read at the earliest possible Committee meeting, then read at the next consecutive meeting with a vote taken at the second reading.
